Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Gibson Environmental Services ("Gibson Environmental Services," "we," "us," or "our"), governing your access to and use of Gibson Environmental Services' services, website, communications, and equipment operations. By requesting a quote, scheduling a service, submitting your information, or otherwise engaging Gibson Environmental Services, you agree to these Terms in full.

1. Services Covered

These Terms apply to all services provided by Gibson Environmental Services, including but not limited to:

• Forestry Mulching & Brush Clearing
• Land & Property Reclamation
• Brush Hogging, Trail Cutting, Fence Line & Lot Clearing, Storm Cleanup
• Equipment-Based Services
• Consulting, Estimates, Quotes & Site Evaluations

2. Estimates, Quotes & Payment Terms

• Every job is quoted as one written project price, based on the information available at the time of quoting. If the scope changes, or site conditions differ materially from what was shown or disclosed, a revised price is agreed in writing before work continues.
• Quotes are valid for 30 days unless otherwise stated.
• Deposit and payment terms, when they apply, are set out in the written quote for each job.
• Payment in full is due immediately upon completion unless otherwise agreed in writing.
• Failure to pay may result in collections, liens, or legal action.

3. Customer Responsibilities

By engaging Gibson Environmental Services, you agree that:

• You are the legal property owner or have authorization from the legal owner.
• You grant Gibson Environmental Services access to the property with heavy machinery.
• You are responsible for disclosing utilities, septic systems, irrigation lines, and other hidden hazards.
• You agree to clearly mark or remove hazards.

4. Property & Equipment Liability Disclaimer

• Gibson Environmental Services operates heavy machinery that may cause ground disturbance.
• Gibson Environmental Services is not liable for cosmetic or incidental damage to lawns, soil, turf, or vegetation during standard operations.
• Customer assumes responsibility for natural changes in terrain resulting from clearing services.

5. Turf Damage Disclaimer

• Gibson Environmental Services is not responsible for turf, sod, gravel, or landscaping damage resulting from equipment working over soft, frozen or uneven ground unless otherwise agreed in writing.

6. SMS Messaging & Communications Policy (A2P 10DLC Compliant)

By providing your phone number, you consent to receive text messages related to:

• Quotes and estimate follow-ups
• Appointment confirmations
• Project updates and scheduling notices

7. Service Limitations & No Warranty

• All services are provided "as-is" with no warranties, unless stated in writing.
• Gibson Environmental Services does not guarantee results impacted by weather, land conditions, wildlife, or natural regrowth.

8. Weather & Scheduling Delays

• Services may be postponed due to weather or equipment conditions.
• Deposits will not be forfeited if Gibson Environmental Services initiates rescheduling.

9. Cancellations & Rescheduling

• Cancellations must be submitted in writing to team@geservesmi.com.
• Smaller jobs may be rescheduled one time at no cost if done 72+ hours in advance.

10. Limitation of Liability

• Gibson Environmental Services' total liability is limited to the total amount paid for services.
• Gibson Environmental Services is not liable for indirect, incidental, or punitive damages.
• Customer agrees to indemnify Gibson Environmental Services for claims arising from undisclosed hazards or property access issues.

11. Governing Law & Dispute Resolution

• These Terms are governed by the laws of the State of Michigan.
• Any disputes will be resolved in the courts of Oakland County, Michigan.

12. Changes to Terms

• Gibson Environmental Services may update these Terms at any time.
• Continued use of our services constitutes acceptance of any updated Terms.
